These Terms of Service ("Terms") govern your use of Kish Rent A Car's vehicle rental services and website. By making a reservation or renting a vehicle from us, you agree to be bound by these Terms. Please read them carefully before proceeding with your booking.

1. Rental Agreement

When you make a reservation with Kish Rent A Car, you enter into a binding rental agreement with us. This agreement consists of these Terms of Service, the specific rental agreement you sign at vehicle pickup, our Privacy Policy, and any additional terms communicated to you during the booking process. The rental period begins at the time specified in your booking confirmation and ends when you return the vehicle to our designated location and we complete the check-in process.

2. Driver Requirements

Age Requirements

The primary driver must be at least 21 years old for standard vehicles and at least 25 years old for luxury vehicles and SUVs. Drivers under 25 years of age may be subject to a young driver surcharge. The maximum age for drivers is 70 years. All drivers must have held a valid driver's license for a minimum of 2 years.

License Requirements

You must present a valid driver's license at the time of vehicle pickup. Omani residents must present their Omani driver's license. GCC nationals may use their home country driver's license. International visitors must present an International Driving Permit (IDP) along with their original national driver's license. Some nationalities may require an officially translated driver's license. All licenses must be valid for the entire rental period and must not be expired, suspended, or revoked.

Additional Drivers

Additional drivers may be added to the rental agreement for a daily fee of 5 OMR per driver. All additional drivers must meet the same age and license requirements as the primary driver, must be present at vehicle pickup to show their documents and sign the rental agreement, and are subject to the same terms and conditions as the primary driver. Only drivers listed on the rental agreement are authorized to operate the vehicle.

3. Vehicle Pickup and Return

Required Documents at Pickup

You must present the following documents at vehicle pickup: valid driver's license (and IDP if applicable), valid passport or Omani ID card, credit card in the primary driver's name for security hold, and booking confirmation (email or QR code). Failure to present any required document may result in denial of rental without refund.

Vehicle Inspection

Before taking possession of the vehicle, you must conduct a thorough inspection in the presence of our staff. We will document any existing damage, scratches, dents, or mechanical issues on the rental agreement. You should verify this documentation and report any discrepancies immediately. Taking photos or videos of the vehicle condition is recommended. You are responsible for any damage not documented at pickup.

Fuel Policy

All vehicles are provided with a full tank of fuel. You must return the vehicle with a full tank of fuel. If the vehicle is returned with less than a full tank, you will be charged a refueling fee of 15 OMR plus the cost of fuel at our prevailing rates. We recommend refueling within 10 kilometers of the return location and keeping the receipt as proof.

Return Procedures

Vehicles must be returned to the location specified in your booking confirmation during our operating hours (8:00 AM - 8:00 PM daily). After-hours returns can be arranged with prior notice and may incur an additional fee. The vehicle must be returned in the same condition as received, clean and free of excessive dirt or odors. Late returns are subject to additional charges as specified in Section 4.

4. Rental Rates and Fees

Daily Rental Rate

The daily rental rate is specified in your booking confirmation and includes the vehicle, unlimited mileage within Oman, basic insurance (Collision Damage Waiver), and 24/7 roadside assistance. The rate does not include fuel, optional extras (GPS, child seats, additional drivers), premium insurance upgrades, or any fines, tolls, or violations incurred during the rental period.

Late Return Fees

A grace period of 1 hour is provided for vehicle returns. Returns more than 1 hour late will incur a late fee of 10 OMR per hour or part thereof. If the vehicle is returned more than 6 hours late without prior authorization, you will be charged for an additional full day at the standard daily rate. Unauthorized extensions beyond 24 hours may be reported as theft.

Additional Fees

The following additional fees may apply: young driver surcharge (10 OMR per day for drivers under 25), additional driver fee (5 OMR per day per driver), GPS navigation device (3 OMR per day), child seat (3 OMR per day), delivery and collection service (free within Muscat city limits, fees apply for other areas), after-hours pickup or return (20 OMR), cleaning fee for excessively dirty vehicles (30 OMR), smoking fee (50 OMR), and cross-border travel insurance (30 OMR per day for UAE travel).

5. Insurance and Liability

Basic Insurance (Included)

All rentals include Basic Insurance (Collision Damage Waiver) with a deductible of 200 OMR. This insurance covers damage to the rental vehicle in the event of a collision or accident, subject to the deductible amount. It also includes third-party liability coverage as required by Omani law.

Insurance Upgrades

You may upgrade to Standard Insurance (100 OMR deductible) for an additional 5 OMR per day, or Premium Insurance (zero deductible) for an additional 10 OMR per day. Premium Insurance provides maximum protection with no out-of-pocket expense for covered damages.

Insurance Exclusions

Insurance coverage does not apply to damage caused by driving under the influence of alcohol or drugs, off-road driving or driving on unpaved roads, reckless or negligent driving, violations of traffic laws, damage to tires, wheels, windshield, or undercarriage (unless caused by collision), interior damage or stains, loss of keys or documents, or driving by unauthorized drivers not listed on the rental agreement.

Your Liability

You are responsible for all damage to the vehicle during the rental period up to the deductible amount specified in your insurance coverage. You are fully responsible for any damage or losses not covered by insurance. You must report all accidents, damage, or theft to us and the police immediately. Failure to report incidents may void insurance coverage.

6. Prohibited Uses

You agree not to use the rental vehicle for any of the following purposes: off-road driving or driving on unpaved roads, racing, speed testing, or any competitive driving, towing or pushing any vehicle or trailer, transporting passengers or goods for hire, transporting illegal substances or contraband, driving while under the influence of alcohol or drugs, allowing unauthorized persons to drive the vehicle, transporting more passengers than the vehicle is designed to carry, smoking in the vehicle (all our vehicles are non-smoking), transporting pets without prior authorization, or using the vehicle for any illegal purpose.

Violation of these prohibited uses will result in immediate termination of the rental agreement, forfeiture of all payments, liability for all damages and losses, and potential legal action. We reserve the right to repossess the vehicle immediately if we believe it is being used in violation of these terms.

7. Traffic Violations and Fines

You are responsible for all traffic violations, parking fines, toll charges, and other penalties incurred during the rental period. We will charge your credit card for any fines or penalties we receive, plus an administrative fee of 10 OMR per violation. You will receive notification of any charges along with documentation of the violation.

Common violations include speeding, illegal parking, running red lights, toll violations, and seat belt violations. We strongly encourage you to obey all traffic laws and regulations. If you believe a fine was issued in error, you are responsible for disputing it with the relevant authorities.

8. Modifications and Cancellations

Booking Modifications

You may modify your booking (change dates, upgrade vehicle, add insurance or extras) through your account dashboard or by contacting us directly. Modifications must be made at least 24 hours before your scheduled pickup time. Price adjustments will apply based on the changes. Modifications are subject to vehicle availability.

Cancellation Policy

Free cancellation is available up to 48 hours before your scheduled pickup time. You will receive a full refund of all payments made. Cancellations made 24-48 hours before pickup incur a 25% cancellation fee. Cancellations within 24 hours of pickup are non-refundable. No-shows (failure to pick up the vehicle without cancellation) result in forfeiture of all payments with no refund.

Early Returns

If you return the vehicle before the scheduled return date, you may be eligible for a partial refund. You must notify us at least 24 hours before the early return. The refund amount is calculated based on unused rental days minus a 15% administrative fee. No refunds are provided for early returns without prior notification.

9. Breakdown and Accidents

Roadside Assistance

We provide 24/7 roadside assistance for all rentals. If you experience a breakdown or mechanical issue, contact us immediately at +968 71 000 270. Our roadside assistance includes emergency towing, flat tire changes, battery jump-starts, lockout service, and fuel delivery (you pay for fuel). Do not attempt repairs yourself or authorize repairs without our prior approval.

Accident Procedures

In the event of an accident, you must stop immediately and ensure the safety of all parties involved. Call emergency services (9999) if there are injuries. Contact the police to file an accident report (required for all accidents in Oman). Contact us immediately at +968 71 000 270 to report the accident. Do not admit fault or make any statements to other parties. Collect information from other drivers involved (name, license, insurance, contact details). Take photos of the accident scene, vehicle damage, and any relevant details. Obtain a copy of the police report. Failure to follow these procedures may void your insurance coverage.

Vehicle Replacement

If the vehicle becomes undriveable due to mechanical failure (not caused by misuse), we will provide a replacement vehicle at no additional charge. If the vehicle is damaged in an accident and you have insurance coverage, we will provide a replacement vehicle for the remainder of your rental period (subject to availability). Replacement vehicles may be of a similar or different category depending on availability.

10. Data Protection and Privacy

We collect and process your personal information in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy. We use your information to process bookings, verify identity, communicate with you, improve our services, and comply with legal requirements. 11. Limitation of Liability

To the maximum extent permitted by law, Kish Rent A Car shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or personal injury not caused by our negligence. Our total liability to you for any claim arising from or related to your rental shall not exceed the total amount paid by you for the rental.

We are not responsible for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, strikes, or technical failures. We do not guarantee the availability of any specific vehicle model, and we reserve the right to substitute vehicles of similar or higher category.

12. Force Majeure

Neither party shall be liable for any failure or delay in performing obligations under this agreement due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government actions, strikes, or severe weather conditions.

Force Majeure Events Include: Tropical cyclones and severe storms affecting Oman, flooding or wadi closures making travel unsafe, government-mandated lockdowns or travel restrictions, airport closures or flight cancellations due to weather, acts of terrorism or civil disturbance, and earthquakes or other natural disasters.

Your Rights During Force Majeure: If a force majeure event prevents you from picking up or continuing your rental, you may cancel your booking for a full refund or reschedule to a future date without penalty. If a force majeure event occurs during your rental period, you will not be charged for days when the vehicle cannot be safely operated due to the event. We will work with you to find a safe location to return the vehicle or extend your rental at no additional cost until safe travel is possible.

Notification Requirements: You must notify us within 24 hours of becoming aware that a force majeure event will affect your rental. We will require reasonable proof of the force majeure event, such as government advisories, flight cancellation notices, or medical certificates. Force majeure refunds will be processed within 7 business days of receiving proper documentation.

13. Detailed Accident and Breakdown Procedures

In the event of an accident, breakdown, or vehicle damage, follow these procedures to ensure your safety and protect your rights:

Immediate Steps After an Accident: (1) Ensure your safety and the safety of others - move to a safe location if possible. (2) Call emergency services (9999) if there are injuries or significant damage. (3) Contact Kish Rent immediately at +968 71 000 270 (available 24/7). (4) Do not admit fault or sign any documents without our authorization. (5) Exchange information with other parties involved (names, phone numbers, license plates, insurance details).

Police Report Requirements: A police report is mandatory for all accidents involving injury, significant vehicle damage (estimated over 200 OMR), or disputes with other parties. For minor damage (scratches, small dents) with no other parties involved, a police report may not be required, but you must still report the incident to us immediately. Failure to obtain a required police report may void your insurance coverage and result in full liability for damages.

Documentation Requirements: Take photos of all vehicle damage from multiple angles, including close-ups and wide shots showing the vehicle's position. Photograph the other vehicle(s) involved and their license plates. Take photos of the accident scene, including road conditions, traffic signs, and skid marks. Collect contact information and statements from any witnesses. Submit all documentation to us within 24 hours via email ([email protected]) or through your account dashboard.

Roadside Assistance Services: Our 24/7 roadside assistance includes tire changes (if spare tire is available), jump-start services for dead batteries, lockout assistance if keys are locked inside, fuel delivery (you pay for fuel cost), and towing to the nearest authorized repair facility (up to 50 km free, additional distance charged at 1 OMR per km). Response time is typically within 60 minutes in Muscat and major cities, up to 2 hours in remote areas.

Replacement Vehicle Policy: If your rental vehicle is undriveable due to an accident or breakdown that is not your fault, we will provide a replacement vehicle of the same or similar category at no additional charge, subject to availability. If the accident or breakdown is due to your negligence or violation of these Terms, you will be charged the standard daily rate for a replacement vehicle. Replacement vehicles are typically provided within 4 hours in Muscat, up to 24 hours in other areas.

Repair Authorization: You must not authorize any repairs to the vehicle without our prior written approval. Unauthorized repairs will not be reimbursed. For emergency repairs necessary to prevent further damage or ensure safety, contact us immediately for authorization. We will direct you to our authorized repair facilities where possible.

14. Cross-Border Travel and Mileage

Our standard rental includes unlimited mileage within the Sultanate of Oman. However, cross-border travel and certain mileage restrictions apply:

United Arab Emirates (UAE) Travel: Cross-border travel to the UAE requires advance authorization and additional insurance (30 OMR per day). Mileage is limited to 300 kilometers per day for UAE travel. Excess mileage is charged at 0.050 OMR per kilometer. You must purchase UAE insurance at least 24 hours before crossing the border. Not all vehicle categories are authorized for UAE travel - please confirm at booking.

Other GCC Countries: Travel to Saudi Arabia, Qatar, Kuwait, or Bahrain is not permitted under standard rental agreements. Special arrangements may be made for long-term rentals (30+ days) with additional insurance and authorization fees. Contact us at least 7 days in advance to request authorization for travel to other GCC countries.

Border Crossing Requirements: You must carry your rental agreement, vehicle registration documents (provided at pickup), UAE insurance certificate (for UAE travel), your passport, and valid visa for the destination country. Failure to present required documents at border crossings may result in denial of entry and you will be responsible for any fines or penalties.

Mileage Verification: Odometer readings are recorded at pickup and return. Tampering with the odometer is a criminal offense and will result in immediate termination of the rental agreement, forfeiture of all payments, and potential legal action. GPS data may be used to verify mileage and detect unauthorized cross-border travel.

15. Electronic Signatures and Digital Agreements

In accordance with the Sultanate of Oman's Electronic Transactions Law (Royal Decree 69/2008), electronic signatures and digital rental agreements have the same legal validity and enforceability as traditional paper documents with handwritten signatures.

Digital Signature Process: When you complete an online booking, you will be asked to review and accept these Terms of Service electronically. Your electronic acceptance (by clicking "I Agree" or similar button) constitutes a legally binding signature. For vehicle pickup, you may sign the rental agreement using our digital signature pad or mobile app. Your digital signature is encrypted and securely stored.

Record Retention: We maintain electronic copies of all rental agreements, including your digital signature, for a minimum of 7 years as required by Omani law. You will receive a copy of your signed rental agreement via email immediately after signing. You can also access your rental agreements at any time through your account dashboard.

Verification: Each electronic signature is associated with a unique identifier, timestamp, and IP address to ensure authenticity and prevent fraud. In the event of a dispute, electronic signatures are admissible as evidence in Omani courts and have the same weight as handwritten signatures.

16. Limitation of Liability

To the maximum extent permitted by Omani law, our total liability to you for any claims arising from your rental shall not exceed three times the total rental fees paid for the affected rental period.

Excluded Liabilities: We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, business interruption, loss of data, loss of goodwill, or personal injury not directly caused by our negligence. We are not liable for delays, cancellations, or route changes caused by traffic, weather, road closures, or other factors beyond our control.

Maintained Liabilities: Nothing in these Terms shall limit our liability for death or personal injury caused by our gross negligence or willful misconduct, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Omani law. We maintain comprehensive insurance coverage for third-party liability as required by Omani law.

Your Acknowledgment: By renting a vehicle from us, you acknowledge that vehicle rental involves inherent risks, including the risk of accidents, breakdowns, and theft. You agree that you are responsible for your own safety and the safety of your passengers, and that you will operate the vehicle in accordance with all applicable laws and these Terms.

17. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any disputes arising from or related to these Terms or your rental shall be subject to the jurisdiction of the courts of Muscat, Oman.

Mandatory Mediation: Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith mediation. Either party may initiate mediation by sending written notice to the other party. Mediation shall be conducted in Muscat, Oman, in English or Arabic as mutually agreed. Each party shall bear their own costs of mediation, with mediator fees split equally.

Arbitration for Small Claims: For disputes involving amounts less than 1,000 OMR, both parties agree to binding arbitration administered by the Oman Chamber of Commerce and Industry in Muscat. The arbitration shall be conducted in English or Arabic as mutually agreed, with each party bearing their own costs and arbitrator fees split equally. The arbitrator's decision shall be final and binding, with limited grounds for appeal.

18. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. For significant changes, we may also send email notifications to registered users. Your continued use of our services after any changes constitutes your acceptance of the modified Terms.
